YOUUcheck Privacy and Data Protection Policy

This Privacy and Data Protection Policy explains how YOUUcheck collects, uses, stores, shares, transfers, protects, discloses, and handles personal data and related user information in connection with the Services. This Policy applies to all users who access or use the Services in any capacity, including content providers, customers, clients, property owners, service providers, contractors, designers, freelancers, companies, account administrators, invited project participants, and other users. By creating an account, registering for the Services, uploading content, submitting project information, using project management tools, purchasing or using Tickens, submitting ratings or reviews, participating in a project workspace, viewing or responding to project information, or otherwise accessing YOUUcheck, you confirm that you have read, understood, and, where consent or agreement is required, agreed to this Policy. We handle personal data in accordance with applicable law, including the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486), which sets out six Data Protection Principles and governs collection, handling, and use of personal data in Hong Kong.
Policy amendments: All users and parties involved in the Services must review and accept any amendment, update, supplement, replacement, or revised version of this Privacy and Data Protection Policy and the YOUUcheck Terms of Service issued from time to time. Continued access to or use of YOUUcheck after an amendment becomes effective constitutes acceptance of the amended documents, except where applicable law requires separate or express consent

2.1 Personal Data We Collect
Depending on how you use the Services, we may collect account details, contact information, business profile information, project information, schedule and budget data, uploaded documents, photos, videos, reviews, messages, usage logs, device and browser information, IP-related information, transaction and payment metadata, customer support communications, and other information you choose to provide. Business profile information, freelancer profile information, company listing information, public reviews, public project showcases, and other information that you choose or authorise to publish may be visible to other users or to the public depending on the relevant feature and settings. Individual project information, including project schedules, budgets, private communications, uploaded project photos, documents, records, reports, and other project-specific materials, is intended to be accessible only to YOUUcheck and the users, project participants, service providers, account administrators, or other persons who are authorised or invited to access the relevant project workspace, except where disclosure is required or permitted by law, necessary for service operation, security, dispute handling, technical support, payment processing, enforcement of our terms, protection of rights or safety, or where a user chooses, authorises, or configures sharing. We will use reasonable measures designed to protect such project information, but we do not guarantee absolute confidentiality, security, or prevention of all unauthorised access, errors, user misconfiguration, third-party failures, or unlawful acts.

2.2 Purposes of Use
We may use personal data to provide and administer the Services; authenticate users; manage projects and reports; process transactions; operate Tickens and account services; maintain company listings; enable user communications and social features; respond to enquiries; improve product performance; secure the Services; prevent fraud and abuse; enforce our terms; comply with legal obligations; and communicate service-related notices. Where required by law, we will obtain consent for specific uses such as certain marketing activities.

2.3 Legal and Compliance Notes
Hong Kong recognises electronic records and electronic signatures in many commercial contexts under the Electronic Transactions Ordinance (Cap. 553), subject to statutory exceptions, which supports online contracting and electronic communications for many transactions.  Personal data should be collected lawfully and fairly, used for purposes directly related to the original collection purpose unless consent or another lawful basis applies, kept accurate, not retained longer than necessary, and protected by appropriate safeguards.

2.4 Personal Data Sharing
We may share personal data with service providers and processors acting on our behalf, including hosting providers, analytics providers, communications vendors, customer support tools, security service providers, and payment processors such as AsiaPay, to the extent reasonably necessary for the purposes described in this Policy. We may also share data with other users when this is part of the Services, such as where company profiles, project showcases, reviews, or collaborative project information are intentionally made visible. We may disclose data where required by law, court order, lawful request, or to protect rights, safety, property, or the integrity of the Services.

2.5 International Transfers
Because YOUUcheck provides transnational services, personal data may be accessed from, stored in, or transferred to jurisdictions outside Hong Kong. Where we transfer personal data across borders, we will take reasonable steps appropriate to the circumstances to ensure that data receives a level of protection consistent with applicable law and this Policy.

2.6 Data Retention and Security
We retain personal data for as long as reasonably necessary for the purposes described in this Policy, including service delivery, dispute handling, record-keeping, fraud prevention, security, backup, and legal compliance. We implement reasonable administrative, technical, and organisational measures intended to protect personal data against unauthorised or accidental access, loss, use, alteration, or disclosure. No system can be guaranteed to be completely secure.

2.7 Your Rights
Subject to applicable law and identity verification, you may request access to personal data we hold about you, request correction of inaccurate data, ask questions about our data handling, and exercise other rights available in your jurisdiction. Under Hong Kong law, data subjects may have rights of access and correction under the Personal Data (Privacy) Ordinance.  Requests may be sent to info@youucheck.com.

2.8 Acceptable Use Policy
You must not use YOUUcheck to engage in unlawful, harmful, deceptive, abusive, infringing, or unsafe conduct. Prohibited conduct includes uploading content you do not have rights to use; posting defamatory or fraudulent material; misrepresenting company credentials, licences, budgets, project progress, or reviews; invading privacy; collecting other users’ data without authorisation; distributing spam or malware; interfering with network or platform security; attempting unauthorised access; using bots or scraping tools in prohibited ways; circumventing payment or access controls; and using the Services to violate laws or third-party rights.
We may investigate violations and take any action we consider appropriate, including content removal, warnings, feature restrictions, account suspension, account termination, reporting to authorities, and legal action, subject to applicable law.

2.9 Law Enforcement Data Request Guidelines
YOUUcheck may disclose user information only where we believe disclosure is legally required, legally permitted, or necessary to respond to valid and lawful requests, protect life or safety, investigate fraud or abuse, or preserve the security and integrity of the Services. We review requests on a case-by-case basis. We generally expect requests to be in writing, issued by an authorised authority, and sufficiently specific to identify the legal basis, the requesting agency, the accounts or records sought, and the applicable time period.
Where permitted, we may require clarification, narrow overly broad requests, reject requests that are invalid or disproportionate, and seek protective measures. Except where prohibited or where doing so would create risk of harm or compromise an investigation, we may notify affected users of requests for their information.

2.10 Government Request Policy
YOUUcheck aims to handle government, regulatory, and law enforcement requests responsibly, lawfully, and with regard to user rights, platform safety, and applicable legal obligations. We may preserve records where reasonably necessary for anticipated legal process or security investigations. We reserve the right to challenge or narrow requests that appear defective, overbroad, inconsistent with applicable law, or lacking proper authority. We may publish transparency information in aggregated form if and when we choose to do so.

2.11 Copyright Policy
YOUUcheck respects intellectual property rights and expects users to do the same. If you believe that content available through the Services infringes copyright or other intellectual property rights, you may send a complaint to info@youucheck.com with sufficient information to identify the work claimed to be infringed, the allegedly infringing material, your contact information, the basis of your claim, and a statement that the information provided is accurate and made in good faith. We may remove or restrict access to challenged material, request additional information, notify the affected user, and take appropriate action under applicable law.
If YOUUcheck offers services to users in the United States and seeks to rely on the online service provider safe-harbour framework under section 512 of the U.S. Copyright Act, a notice-and-takedown process and designated agent information may be required as part of compliance. The U.S. Copyright Office explains that participating online service providers generally need to cooperate with notice-and-takedown procedures and designate an agent for copyright notices.

2.12 International Terms Addendum and Country-Specific Schedules

2.12.1 General International Availability
YOUUcheck is operated from Hong Kong SAR and may be accessible from multiple jurisdictions. We do not represent that the Services, any feature, any paid service, any Tickens function, any company listing, any rating system, or any content is appropriate, lawful, available, or approved for use in every country or region. We may restrict, suspend, modify, block, geofence, or discontinue access to all or part of the Services in any jurisdiction at any time where we consider it necessary or appropriate for legal, regulatory, operational, payment, security, sanctions, technical, or business reasons.

2.12.2 Mandatory Local Law and User Responsibility
If you access or use the Services from outside Hong Kong SAR, you are responsible for complying with all laws and regulations that apply to you, your organisation, your project, your profession, your content, and your use of the Services. Where mandatory local law gives you rights or protections that cannot legally be waived or limited by contract, those rights and protections will apply only to the extent required by that mandatory law. Nothing in these Terms is intended to exclude, restrict, or modify any non-excludable consumer, privacy, employment, data protection, platform safety, or statutory right that applies to you.

2.12.3 Local Project, Professional, Contractor, and Marketplace Laws
Users are solely responsible for complying with all local laws, regulations, codes, permits, licences, registrations, qualifications, professional standards, insurance requirements, employment rules, tax obligations, safety requirements, consumer protection duties, construction and renovation rules, property management rules, and trade or contractor obligations that apply to their projects, services, businesses, listings, quotations, communications, uploaded materials, ratings, reviews, and transactions. YOUUcheck does not verify, supervise, control, inspect, certify, licence, guarantee, or assume responsibility for whether any user, freelancer, company, contractor, designer, consultant, supplier, owner, client, project participant, project, quotation, work, service, material, schedule, budget, upload, or transaction complies with local law or professional requirements.
Public profiles, company listings, freelancer listings, ratings, rankings, reviews, quotations, calendar entries, project records, reports, database information, and platform tools are provided to support user communication, record management, discovery, and project follow-up only. They do not constitute YOUUcheck’s endorsement, approval, guarantee, verification, certification, professional recommendation, project supervision, legal advice, construction advice, financial advice, or assumption of responsibility for any user or project. Where local laws impose obligations directly on owners, clients, designers, contractors, freelancers, companies, suppliers, professionals, employers, or other users, those obligations remain with the relevant users unless mandatory law expressly provides otherwise.
YOUUcheck may, but is not obliged to, request evidence of compliance, restrict features, suspend accounts, remove or de-rank listings, remove content, disable ratings or reviews, block transactions, limit project workspaces, or restrict access in any jurisdiction where we believe there may be legal, regulatory, safety, professional, consumer, payment, reputational, or platform-integrity risk. Any such action or inaction does not make YOUUcheck responsible for the underlying project, user relationship, contract, quotation, service, work, payment, dispute, or legal compliance matter.
2.12.4 International Data Transfers and Local Access Restrictions
By using the Services, you understand that information may be processed, stored, accessed, supported, backed up, or transferred in or from jurisdictions other than the one in which you are located. We will take reasonable steps appropriate to the circumstances to protect personal data in accordance with applicable law and our Privacy Policy. Some jurisdictions may restrict cross-border transfer, remote access, hosting, or publication of certain data, including personal data, project information, geolocation information, construction or property-related records, sensitive documents, minor-related data, or professional records. Users must not upload, transfer, publish, or invite access to information where doing so would violate applicable law or contractual duties owed to others.

2.12.5 Sanctions, Export Controls, and Prohibited Territories
You must not access, use, purchase, sell, transfer, or make available the Services, Tickens, reports, software, technical information, or platform content in breach of applicable sanctions, export control, trade control, anti-money laundering, anti-bribery, anti-corruption, or counter-terrorism financing laws. You represent that you are not located in, organised under the laws of, ordinarily resident in, or acting on behalf of any person or entity in a jurisdiction or on a list where use of the Services would be prohibited. We may screen, restrict, reject, suspend, or terminate accounts, payments, transactions, or access where we believe this is necessary for compliance or risk management.

2.12.6 International Ratings, Reviews, and Rankings
YOUUcheck’s ratings, review tools, validation process, scoring categories, database records, and ranking lists may be subject to consumer protection, advertising, unfair competition, defamation, professional regulation, platform transparency, and anti-manipulation rules in different jurisdictions. Users must not buy, sell, trade, coerce, threaten, fake, suppress, manipulate, or coordinate ratings or reviews. YOUUcheck may moderate, validate, remove, de-rank, adjust, or refuse to publish ratings and rankings where we consider it appropriate for fairness, authenticity, legal compliance, user trust, or platform integrity. Scores and rankings are informational tools only and are not guarantees of quality, licensing, legality, safety, financial condition, professional competence, or future performance.

2.12.7 Minors and Guardian Consent Across Jurisdictions
Where users below the age of majority are permitted to use the Services, such use must be with the consent and supervision of a parent or legal guardian. Age thresholds, parental consent rules, child privacy rules, age-assurance requirements, advertising restrictions, and public-sharing restrictions differ by jurisdiction. YOUUcheck may impose age gates, consent checks, feature restrictions, account limitations, content limitations, or additional verification requirements where we consider this necessary or appropriate. Parents and guardians are responsible for supervising minors’ use of the Services and for ensuring that minors do not upload sensitive project information, personal data, images, videos, or other content without appropriate rights and consent.
Schedule A – United States
If you are located in the United States, federal and state laws may impose additional requirements concerning consumer protection, privacy, children’s data, electronic contracting, automatic renewals, copyright, advertising, reviews, dispute resolution, and unfair or deceptive practices. California residents may have privacy rights under the California Consumer Privacy Act as amended, including rights to know, delete, correct, opt out of certain sale or sharing, limit certain sensitive information use, and avoid discrimination for exercising rights, where the law applies to the business. The California Attorney General describes the CCPA as giving consumers more control over personal information collected about them and requiring covered businesses to provide notices and respond to consumer requests.
If YOUUcheck is directed to children under 13 in the United States or has actual knowledge that it collects personal information from children under 13, the U.S. Children’s Online Privacy Protection Rule may require notice and verifiable parental consent before collecting, using, or disclosing such personal information. The U.S. Federal Trade Commission explains that the COPPA Rule sets out what covered operators must do to protect children’s privacy and safety online, including parental consent requirements.  YOUUcheck may restrict or modify access for users under relevant age thresholds where needed.
If YOUUcheck seeks to rely on U.S. online service provider copyright safe-harbour rules, additional operational steps may be required, including appropriate notice-and-takedown procedures and designated agent information. Any arbitration, class action waiver, jury waiver, or limitation of remedies applicable to U.S. users should be reviewed by U.S. counsel before adoption, because enforceability may vary by state, claim type, consumer status, and presentation of the terms.
Schedule B – European Union and United Kingdom
If YOUUcheck actively offers Services to users in the European Union, European Economic Area, or United Kingdom, additional data protection, consumer, platform, and online safety obligations may apply. Where the EU General Data Protection Regulation, UK GDPR, or related national laws apply, users may have rights such as access, correction, deletion, objection, restriction, portability, and rights relating to certain automated decisions. YOUUcheck may need to identify applicable controller or processor roles, lawful bases, international transfer safeguards, retention rules, security measures, and representative or contact arrangements.
The EU Digital Services Act establishes due diligence and transparency obligations for certain intermediary services offered to users in the EU, including points of contact for authorities and recipients, notice-and-action mechanisms for hosting services, and additional obligations for online platforms depending on service type and size.  If YOUUcheck falls within scope, it may need to maintain required contact points, content reporting processes, moderation explanations, complaint handling, transparency reporting, and trader or business-user information processes.
In the United Kingdom, the Online Safety Act 2023 may apply to certain user-to-user or search services, including duties relating to illegal content risk assessments, safety measures, record-keeping, content reporting, complaints procedures, and child safety where the service is likely to be accessed by children.  YOUUcheck may restrict features, sharing, messaging, public posts, or minor access in the UK where needed for compliance.
Schedule C – Australia
If you are an Australian consumer or small business, the Australian Consumer Law may provide guarantees, remedies, and protections that cannot be excluded, including protections concerning services provided with due care and skill, misleading or deceptive conduct, unfair practices, unfair contract terms, and refund rights where statutory guarantees are not met. The Australian Competition and Consumer Commission explains that consumer rights under law cannot be taken away by contract terms and that laws protect consumers and small businesses from unfair terms in standard form contracts.
For Australian users, any refund, limitation of liability, unilateral variation, ranking, review, suspension, or termination clause in these Terms applies only to the extent permitted by the Australian Consumer Law and other applicable laws. YOUUcheck’s review and ranking features must not be used to publish false, misleading, manipulated, or unfairly obtained reviews or ratings.
Schedule D – Singapore
If Singapore law applies to YOUUcheck’s handling of personal data, the Personal Data Protection Act 2012 may require compliance with obligations including accountability, notification, consent, purpose limitation, accuracy, protection, retention limitation, transfer limitation, access, correction, and data breach notification. Singapore’s Personal Data Protection Commission describes these data protection obligations and the expectation that organisations designate a data protection officer and make relevant business contact information available.
Where Singapore PDPA requirements apply, requests relating to access, correction, withdrawal of consent, complaints, or data protection matters may be sent to info@youucheck.com. YOUUcheck may require identity verification, limit requests where permitted by law, and respond within timeframes required by applicable law.
Schedule E – Mainland China
If YOUUcheck processes personal information of individuals located in Mainland China for the purpose of providing products or services to them or analysing or evaluating their behaviour, Mainland China’s Personal Information Protection Law and related cybersecurity, data security, content, data export, and platform rules may apply. Public summaries of the PIPL note that it has extraterritorial reach and may require specific processing bases, notices, separate consent for certain activities, individual rights, security measures, and cross-border transfer compliance.
YOUUcheck may restrict Mainland China access, accounts, features, content publication, public listings, messaging, data transfers, payments, or project data uploads where we consider it necessary for compliance, licensing, security, content control, data export, or operational reasons. Users must not upload or transfer information from Mainland China where doing so would breach applicable data localisation, cybersecurity, professional, confidentiality, state secrets, mapping, construction, property, employment, or personal information rules.
Schedule F – Macau SAR and Taiwan
If you access the Services from Macau SAR or Taiwan, local privacy, consumer, electronic transaction, advertising, defamation, professional, and platform-related laws may apply. YOUUcheck may provide additional notices or localised terms where required. Users are responsible for ensuring that company listings, professional claims, reviews, project information, and uploaded materials are lawful and accurate under applicable local law.
Schedule G – Japan
If YOUUcheck handles personal information of individuals in Japan in connection with providing goods or services, Japan’s Act on the Protection of Personal Information may apply, including rules concerning purposes of use, third-party provision, cross-border transfers, data subject rights, security controls, and breach notification. Japan’s Personal Information Protection Commission publishes materials relating to the Act on the Protection of Personal Information and related rules and guidelines.
Schedule H – Canada
If YOUUcheck handles personal information in the course of commercial activities involving Canada, the Personal Information Protection and Electronic Documents Act or substantially similar provincial privacy laws may apply. The Office of the Privacy Commissioner of Canada explains that PIPEDA sets ground rules for how private-sector organisations collect, use, and disclose personal information in commercial activities and is based on principles including accountability, identifying purposes, consent, limiting collection, safeguards, openness, individual access, and challenging compliance.
Schedule I – Other Jurisdictions and Future Local Terms
For any country or region not specifically listed above, local laws may still apply to privacy, consumer protection, professional regulation, construction and property services, electronic contracting, payments, advertising, intellectual property, defamation, online safety, user-generated content, minors, dispute resolution, taxation, sanctions, and data transfers. YOUUcheck may issue additional country-specific terms, product notices, consent flows, privacy disclosures, payment terms, or feature restrictions as the Services expand. If any local addendum conflicts with these Terms, the local addendum will control only for the relevant jurisdiction and only to the extent of the conflict.
Privacy-related international notices: Additional privacy, personal data, data transfer, child privacy, and government-access requirements for specific countries or regions are also addressed in the YOUUcheck Privacy and Data Protection Policy. Where a privacy-specific local notice conflicts with these Terms, the privacy-specific notice will apply only to the extent required by applicable law.

本隐私与数据保护政策说明悠评如何在服务相关情况下收集、使用、存储、分享、转移、保护、披露及处理个人数据和相关用户信息。本政策适用于以任何身份访问或使用服务的所有用户,包括内容提供者、消费者、客户、业主、服务提供商、承包商、设计师、自由职业者、公司、账户管理员、受邀项目参与者及其他用户。凡创建账户、注册使用服务、上传内容、提交项目信息、使用项目管理工具、购买或使用悠币、提交评分或评价、参与项目工作区、查看或回应项目信息,或以其他方式访问悠评,即表示您确认已阅读、理解并在需要同意或确认的范围内同意本政策。我们按照适用法律处理个人数据,包括香港《个人资料(私隐)条例》(第486章),该条例规定六项保障资料原则,并规管香港个人数据的收集、处理和使用。
政策修订:所有用户及参与服务的各方,均须不时审阅并接受本隐私与数据保护政策及悠评服务条款的任何修订、更新、补充、替换或新版文件。在任何修订生效后继续访问或使用悠评,即表示接受经修订的文件,但适用法律要求另行或明示同意的除外。

2.1 我们收集的个人数据
视您使用服务的方式而定,我们可能收集账户资料、联系方式、业务资料、项目信息、进度和预算数据、上传文件、照片、视频、评价、消息、使用日志、设备和浏览器信息、与IP相关的信息、交易和付款元数据、客户支持通信,以及您选择提供的其他信息。业务资料、自由职业者资料、公司列表信息、公开评价、公开项目展示,以及您选择或授权发布的其他信息,可能会根据相关功能和设置向其他用户或公众可见。个人项目资料,包括项目进度、预算、私人通信、上传的项目照片、文件、记录、报告及其他项目特定材料,原则上仅供悠评以及获授权或受邀访问相关项目工作区的用户、项目参与者、服务提供商、账户管理员或其他人员访问;但在法律要求或允许、服务运营、安全、争议处理、技术支持、付款处理、执行我们的条款、保护权利或安全,或用户选择、授权或配置分享的情况下,可能会披露。我们将采用合理措施保护该等项目资料,但不保证绝对保密、安全,亦不保证能够防止所有未经授权访问、错误、用户配置不当、第三方故障或违法行为。

2.2 使用目的
我们可使用个人数据以提供及管理服务;验证用户身份;管理项目和报告;处理交易;运营悠币及账户服务;维护公司列表;实现用户通信及社交功能;回应查询;改进产品性能;保障服务安全;防止欺诈和滥用;执行我们的条款;遵守法律义务;以及发送与服务相关的通知。在法律要求的情况下,我们将就特定用途取得同意,例如某些营销活动。

2.3 法律与合规说明
根据香港《电子交易条例》(第553章),在若干法定例外的限制下,香港在许多商业情境中承认电子记录和电子签名,从而支持许多交易中的线上订约及电子通信。个人数据应以合法和公平方式收集;除非取得同意或另有合法依据,否则应仅用于与原收集目的直接相关的用途;并应保持准确、不得保留超过必要期限,且应以适当保障措施予以保护。

2.4 个人数据共享
在为本政策所述目的而合理必要的范围内,我们可与代表我们行事的服务提供商和处理者分享个人数据,包括托管服务提供商、分析服务提供商、通讯供应商、客户支持工具、安全服务提供商,以及AsiaPay等付款处理机构。当服务功能本身需要向其他用户分享数据时,例如用户有意公开公司资料、项目展示、评价或协作项目信息,我们亦可进行分享。我们亦可在法律、法院命令、合法请求要求时,或为保护权利、安全、财产或服务完整性而披露数据。

2.5 国际转移
由于悠评提供跨境服务,个人数据可能会从香港以外的司法管辖区被访问、存储或转移至该等司法管辖区。当我们跨境转移个人数据时,我们将根据具体情况采取合理步骤,以确保数据获得与适用法律及本政策相一致的保护水平。

2.6 数据保留与安全
我们会在为本政策所述目的合理必要的期间内保留个人数据,包括服务提供、争议处理、记录保存、防止欺诈、安全、备份及法律合规。我们实施合理的行政、技术及组织措施,旨在保护个人数据免遭未经授权或意外访问、遗失、使用、变更或披露。任何系统均不能保证完全安全。

2.7 您的权利
在适用法律及身份验证的规限下,您可请求访问我们持有的关于您的个人数据,请求更正不准确的数据,就我们的数据处理提出问题,并行使您所在司法管辖区可享有的其他权利。根据香港法律,资料当事人可根据《个人资料(私隐)条例》享有查阅及更正资料的权利。相关请求可发送至info@youucheck.com

2.8 可接受使用政策
您不得使用悠评从事违法、有害、欺骗、滥用、侵权或不安全的行为。禁止行为包括上传您无权使用的内容;发布诽谤性或欺诈性材料;虚假陈述公司资质、许可证、预算、项目进度或评价;侵犯隐私;未经授权收集其他用户数据;传播垃圾信息或恶意软件;干扰网络或平台安全;尝试未经授权访问;以被禁止方式使用机器人或抓取工具;规避付款或访问控制;以及使用服务违反法律或第三方权利。
我们可调查违规行为,并在适用法律规限下采取我们认为适当的任何措施,包括移除内容、发出警告、限制功能、暂停账户、终止账户、向有关机关报告及采取法律行动。

2.9 执法数据请求指南

悠评旨在以负责任、合法并兼顾用户权利、平台安全及适用法律义务的方式处理政府、监管及执法请求。我们可在预期法律程序或安全调查合理需要时保存记录。我们保留质疑或缩小看来存在缺陷、过于宽泛、不符合适用法律或缺乏适当权限的请求的权利。我们可在选择这样做时以汇总形式发布透明度信息。

2.11 版权政策
悠评尊重知识产权,并要求用户亦同样尊重知识产权。如果您认为服务中可用的内容侵犯版权或其他知识产权,您可向info@youucheck.com发送投诉,并提供足够资料以识别据称被侵权的作品、涉嫌侵权的材料、您的联系方式、您的投诉依据,以及一项声明,确认所提供资料准确且基于善意作出。我们可移除或限制对被投诉材料的访问,要求提供补充资料,通知受影响用户,并根据适用法律采取适当行动。
如果悠评向美国用户提供服务,并希望依据美国《版权法》第512条项下的在线服务提供商安全港框架,则作为合规的一部分,可能需要建立通知与移除程序,并提供指定代理人信息。参与该等安全港机制的在线服务提供商通常需要配合通知与移除程序,并指定版权通知代理人。

2.12 国际条款附录及国家/地区特定附表

2.12.1 一般国际可用性
悠评由香港特别行政区运营,并可能可从多个司法管辖区访问。我们不声明服务、任何功能、任何付费服务、任何悠币功能、任何公司列表、任何评分系统或任何内容在每个国家或地区均适当、合法、可用或获批准使用。凡我们认为因法律、监管、运营、付款、安全、制裁、技术或商业原因有必要或适当时,我们可在任何司法管辖区随时限制、暂停、修改、阻止、按地区限制或终止对全部或部分服务的访问。

2.12.2 强制性当地法律与用户责任
如您从香港特别行政区以外访问或使用服务,您有责任遵守适用于您、您的组织、您的项目、您的专业、您的内容及您使用服务的所有法律法规。凡强制性当地法律赋予您不得通过合同合法放弃或限制的权利或保护,该等权利和保护仅在该强制性法律要求的范围内适用。本条款中的任何内容均无意排除、限制或修改适用于您的任何不可排除的消费者、隐私、雇佣、数据保护、平台安全或法定权利。

2.12.3 当地项目、专业、承包商及市场法律
用户须自行负责遵守适用于其项目、服务、业务、列表、报价、通信、上传材料、评分、评价及交易的所有当地法律、法规、守则、许可、牌照、登记、资质、专业标准、保险要求、雇佣规则、税务义务、安全要求、消费者保护义务、施工及装修规则、物业管理规则,以及行业或承包商义务。悠评不核实、监督、控制、检查、认证、发牌、保证或承担任何用户、自由职业者、公司、承包商、设计师、顾问、供应商、业主、客户、项目参与者、项目、报价、工程、服务、材料、进度、预算、上传内容或交易是否符合当地法律或专业要求的责任。
公开资料、公司列表、自由职业者列表、评分、排名、评价、报价、日历条目、项目记录、报告、数据库信息及平台工具仅用于支持用户沟通、记录管理、发现及项目跟进。其不构成悠评对任何用户或项目的背书、批准、保证、核实、认证、专业推荐、项目监督、法律意见、施工意见、财务意见或责任承担。凡当地法律直接对业主、客户、设计师、承包商、自由职业者、公司、供应商、专业人士、雇主或其他用户施加义务,该等义务仍由相关用户承担,除非强制性法律另有明确规定。
凡我们认为在任何司法管辖区可能存在法律、监管、安全、专业、消费者、付款、声誉或平台完整性风险时,悠评可要求提供合规证明、限制功能、暂停账户、移除或降低列表排名、移除内容、禁用评分或评价、阻止交易、限制项目工作区,或限制访问,但我们并无义务这样做。任何该等作为或不作为均不使悠评对相关项目、用户关系、合同、报价、服务、工程、付款、争议或法律合规事项承担责任。

2.12.4 国际数据转移及当地访问限制
使用服务即表示您理解,信息可能会在您所在司法管辖区以外的地区被处理、存储、访问、支持、备份或转移。我们将根据具体情况采取合理步骤,按照适用法律及我们的隐私政策保护个人数据。某些司法管辖区可能限制特定数据的跨境转移、远程访问、托管或发布,包括个人数据、项目信息、地理位置信息、施工或物业相关记录、敏感文件、未成年人相关数据或专业记录。用户不得上传、转移、发布或邀请访问任何会违反适用法律或其对他人承担的合同义务的信息。

2.12.5 制裁、出口管制及禁止地区
您不得在违反适用制裁、出口管制、贸易管制、反洗钱、反贿赂、反腐败或反恐怖融资法律的情况下访问、使用、购买、出售、转移或提供服务、悠币、报告、软件、技术信息或平台内容。您声明您并非位于、根据其法律设立、通常居住于或代表任何在有关司法管辖区或名单上、使使用服务被禁止的人士或实体行事。凡我们认为出于合规或风险管理需要时,我们可筛查、限制、拒绝、暂停或终止账户、付款、交易或访问。

2.12.6 国际评分、评价及排名
悠评的评分、评价工具、验证流程、评分类别、数据库记录及排名列表,在不同司法管辖区可能受消费者保护、广告、不正当竞争、诽谤、专业监管、平台透明度及反操纵规则约束。用户不得购买、出售、交换、胁迫、威胁、伪造、压制、操纵或协调评分或评价。凡我们认为出于公平性、真实性、法律合规、用户信任或平台完整性需要时,悠评可管理、验证、移除、降低排名、调整或拒绝发布评分及排名。评分和排名仅为信息工具,并非对质量、牌照、合法性、安全、财务状况、专业能力或未来表现的保证。

2.12.7 各司法管辖区的未成年人及监护人同意
凡允许未达到成年年龄的用户使用服务,该等使用必须取得父母或法定监护人的同意并受其监督。不同司法管辖区对于年龄门槛、父母同意、儿童隐私、年龄确认、广告限制及公开分享限制的规定各不相同。悠评可在我们认为必要或适当时设置年龄限制、同意检查、功能限制、账户限制、内容限制或额外验证要求。父母及监护人负责监督未成年人使用服务,并确保未成年人不会在未取得适当权利和同意的情况下上传敏感项目信息、个人数据、图像、视频或其他内容。

附表A-美国
如您位于美国,联邦及州法律可能就消费者保护、隐私、儿童数据、电子订约、自动续期、版权、广告、评价、争议解决以及不公平或欺骗性行为施加额外要求。加利福尼亚居民在适用法律适用于相关业务的情况下,可能根据经修订的《加利福尼亚消费者隐私法》享有隐私权,包括知情权、删除权、更正权、选择退出某些出售或共享的权利、限制某些敏感信息使用的权利,以及因行使权利而不受歧视的权利。
如悠评面向美国13岁以下儿童,或实际知悉其收集13岁以下儿童的个人信息,美国《儿童在线隐私保护规则》可能要求在收集、使用或披露该等个人信息前提供通知并取得可验证的父母同意。悠评可在需要时限制或修改低于相关年龄门槛用户的访问。
如悠评希望依赖美国在线服务提供商版权安全港规则,可能需要采取额外运营步骤,包括适当的通知与移除程序及指定代理人信息。任何适用于美国用户的仲裁、集体诉讼豁免、陪审团审判豁免或救济限制条款,在采用前均应由美国律师审查,因为其可执行性可能因州份、索赔类型、消费者身份及条款呈现方式而异。

附表B-欧盟和英国
如悠评主动向欧盟、欧洲经济区或英国用户提供服务,可能适用额外的数据保护、消费者、平台及在线安全义务。在欧盟《通用数据保护条例》、英国GDPR或相关国家法律适用的情况下,用户可能享有访问、更正、删除、反对、限制、数据可携带,以及与某些自动化决定有关的权利。悠评可能需要识别适用的控制者或处理者角色、合法依据、国际转移保障措施、保留规则、安全措施,以及代表或联络安排。
欧盟《数字服务法》为向欧盟用户提供的某些中介服务设立尽职调查及透明度义务,包括面向主管机关及服务接收方的联系点、托管服务的通知与行动机制,以及视服务类型和规模而定的在线平台额外义务。如悠评属于适用范围,可能需要维持所需联系点、内容举报流程、内容管理说明、投诉处理、透明度报告,以及交易者或商业用户信息流程。
在英国,《2023年在线安全法》可能适用于某些用户对用户服务或搜索服务,包括与非法内容风险评估、安全措施、记录保存、内容举报、投诉程序,以及在服务可能被儿童访问时的儿童安全有关的义务。悠评可在为合规所需时限制英国境内的功能、分享、消息、公开帖子或未成年人访问。

附表C-澳大利亚
如您是澳大利亚消费者或小型企业,澳大利亚消费者法可能赋予不可排除的保证、救济和保护,包括关于以适当谨慎和技能提供服务、误导或欺骗性行为、不公平做法、不公平合同条款,以及在未达到法定保证时的退款权利等保护。任何退款、责任限制、单方变更、排名、评价、暂停或终止条款,仅在澳大利亚消费者法及其他适用法律允许的范围内适用于澳大利亚用户。
悠评的评价和排名功能不得用于发布虚假、误导、被操纵或以不公平方式取得的评价或评分。凡法律要求给予消费者保证或法定救济,本条款不得解释为排除、限制或修改该等不可排除权利。

附表D-新加坡
如新加坡法律适用于悠评处理个人数据的活动,《2012年个人数据保护法》可能要求遵守包括问责、通知、同意、目的限制、准确性、保护、保留限制、转移限制、访问、更正及数据泄露通知在内的义务。组织通常应指定数据保护负责人,并提供相关业务联系方式。
在新加坡PDPA要求适用的情况下,与访问、更正、撤回同意、投诉或数据保护事项有关的请求可发送至info@youucheck.com。悠评可要求进行身份验证,在法律允许范围内限制请求,并在适用法律要求的时限内作出回应。

附表E-中国内地
如悠评为向位于中国内地的个人提供产品或服务,或分析、评估其行为而处理该等个人的个人信息,中国内地的《个人信息保护法》以及相关网络安全、数据安全、内容、数据出境及平台规则可能适用。该等规则可能要求具备特定处理依据、提供通知、就若干活动取得单独同意、保障个人权利、采取安全措施,并遵守跨境转移合规要求。
凡我们认为出于合规、许可、安全、内容管理、数据出境或运营原因有必要时,悠评可限制中国内地访问、账户、功能、内容发布、公开列表、消息、数据转移、付款或项目数据上传。用户不得从中国内地上传或转移会违反适用数据本地化、网络安全、专业、保密、国家秘密、测绘、施工、物业、雇佣或个人信息规则的信息。

附表F-澳门特别行政区和台湾
如您从澳门特别行政区或台湾访问服务,当地隐私、消费者、电子交易、广告、诽谤、专业及平台相关法律可能适用。悠评可在法律要求时提供额外通知或本地化条款。用户负责确保公司列表、专业声明、评价、项目信息及上传材料在适用当地法律下合法且准确。

附表G-日本
如悠评在提供商品或服务相关情况下处理日本个人的个人信息,日本《个人信息保护法》可能适用,包括关于使用目的、向第三方提供、跨境转移、数据主体权利、安全控制及泄露通知的规则。悠评可在必要时提供额外通知、同意流程或本地化隐私说明。

附表H-加拿大
如悠评在涉及加拿大的商业活动中处理个人信息,《个人信息保护和电子文件法》或实质类似的省级隐私法律可能适用。该等法律通常规范私营机构在商业活动中如何收集、使用和披露个人信息,并体现问责、说明目的、同意、限制收集、保障措施、公开透明、个人访问及质疑合规等原则。

附表I-其他司法管辖区及未来本地条款
对于上文未具体列明的任何国家或地区,当地法律仍可能适用于隐私、消费者保护、专业监管、施工及物业服务、电子订约、付款、广告、知识产权、诽谤、在线安全、用户生成内容、未成年人、争议解决、税务、制裁及数据转移。随着服务扩展,悠评可发布额外的国家或地区特定条款、产品通知、同意流程、隐私披露、付款条款或功能限制。如任何本地附录与本条款冲突,该本地附录仅就相关司法管辖区且仅在冲突范围内优先适用。
隐私相关国际通知:特定国家或地区的额外隐私、个人数据、数据转移、儿童隐私及政府访问要求,亦载于《悠评隐私与数据保护政策》。凡隐私特定本地通知与本条款冲突,该隐私特定通知仅在适用法律要求的范围内适用。

YOUUcheck Privacy and Data Protection Policy

This Privacy and Data Protection Policy explains how YOUUcheck collects, uses, stores, shares, transfers, protects, discloses, and handles personal data and related user information in connection with the Services. This Policy applies to all users who access or use the Services in any capacity, including content providers, customers, clients, property owners, service providers, contractors, designers, freelancers, companies, account administrators, invited project participants, and other users. By creating an account, registering for the Services, uploading content, submitting project information, using project management tools, purchasing or using Tickens, submitting ratings or reviews, participating in a project workspace, viewing or responding to project information, or otherwise accessing YOUUcheck, you confirm that you have read, understood, and, where consent or agreement is required, agreed to this Policy. We handle personal data in accordance with applicable law, including the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486), which sets out six Data Protection Principles and governs collection, handling, and use of personal data in Hong Kong.
Policy amendments: All users and parties involved in the Services must review and accept any amendment, update, supplement, replacement, or revised version of this Privacy and Data Protection Policy and the YOUUcheck Terms of Service issued from time to time. Continued access to or use of YOUUcheck after an amendment becomes effective constitutes acceptance of the amended documents, except where applicable law requires separate or express consent

2.1 Personal Data We Collect
Depending on how you use the Services, we may collect account details, contact information, business profile information, project information, schedule and budget data, uploaded documents, photos, videos, reviews, messages, usage logs, device and browser information, IP-related information, transaction and payment metadata, customer support communications, and other information you choose to provide. Business profile information, freelancer profile information, company listing information, public reviews, public project showcases, and other information that you choose or authorise to publish may be visible to other users or to the public depending on the relevant feature and settings. Individual project information, including project schedules, budgets, private communications, uploaded project photos, documents, records, reports, and other project-specific materials, is intended to be accessible only to YOUUcheck and the users, project participants, service providers, account administrators, or other persons who are authorised or invited to access the relevant project workspace, except where disclosure is required or permitted by law, necessary for service operation, security, dispute handling, technical support, payment processing, enforcement of our terms, protection of rights or safety, or where a user chooses, authorises, or configures sharing. We will use reasonable measures designed to protect such project information, but we do not guarantee absolute confidentiality, security, or prevention of all unauthorised access, errors, user misconfiguration, third-party failures, or unlawful acts.

2.2 Purposes of Use
We may use personal data to provide and administer the Services; authenticate users; manage projects and reports; process transactions; operate Tickens and account services; maintain company listings; enable user communications and social features; respond to enquiries; improve product performance; secure the Services; prevent fraud and abuse; enforce our terms; comply with legal obligations; and communicate service-related notices. Where required by law, we will obtain consent for specific uses such as certain marketing activities.

2.3 Legal and Compliance Notes
Hong Kong recognises electronic records and electronic signatures in many commercial contexts under the Electronic Transactions Ordinance (Cap. 553), subject to statutory exceptions, which supports online contracting and electronic communications for many transactions.  Personal data should be collected lawfully and fairly, used for purposes directly related to the original collection purpose unless consent or another lawful basis applies, kept accurate, not retained longer than necessary, and protected by appropriate safeguards.

2.4 Personal Data Sharing
We may share personal data with service providers and processors acting on our behalf, including hosting providers, analytics providers, communications vendors, customer support tools, security service providers, and payment processors such as AsiaPay, to the extent reasonably necessary for the purposes described in this Policy. We may also share data with other users when this is part of the Services, such as where company profiles, project showcases, reviews, or collaborative project information are intentionally made visible. We may disclose data where required by law, court order, lawful request, or to protect rights, safety, property, or the integrity of the Services.

2.5 International Transfers
Because YOUUcheck provides transnational services, personal data may be accessed from, stored in, or transferred to jurisdictions outside Hong Kong. Where we transfer personal data across borders, we will take reasonable steps appropriate to the circumstances to ensure that data receives a level of protection consistent with applicable law and this Policy.

2.6 Data Retention and Security
We retain personal data for as long as reasonably necessary for the purposes described in this Policy, including service delivery, dispute handling, record-keeping, fraud prevention, security, backup, and legal compliance. We implement reasonable administrative, technical, and organisational measures intended to protect personal data against unauthorised or accidental access, loss, use, alteration, or disclosure. No system can be guaranteed to be completely secure.

2.7 Your Rights
Subject to applicable law and identity verification, you may request access to personal data we hold about you, request correction of inaccurate data, ask questions about our data handling, and exercise other rights available in your jurisdiction. Under Hong Kong law, data subjects may have rights of access and correction under the Personal Data (Privacy) Ordinance.  Requests may be sent to info@youucheck.com.

2.8 Acceptable Use Policy
You must not use YOUUcheck to engage in unlawful, harmful, deceptive, abusive, infringing, or unsafe conduct. Prohibited conduct includes uploading content you do not have rights to use; posting defamatory or fraudulent material; misrepresenting company credentials, licences, budgets, project progress, or reviews; invading privacy; collecting other users’ data without authorisation; distributing spam or malware; interfering with network or platform security; attempting unauthorised access; using bots or scraping tools in prohibited ways; circumventing payment or access controls; and using the Services to violate laws or third-party rights.
We may investigate violations and take any action we consider appropriate, including content removal, warnings, feature restrictions, account suspension, account termination, reporting to authorities, and legal action, subject to applicable law.

2.9 Law Enforcement Data Request Guidelines
YOUUcheck may disclose user information only where we believe disclosure is legally required, legally permitted, or necessary to respond to valid and lawful requests, protect life or safety, investigate fraud or abuse, or preserve the security and integrity of the Services. We review requests on a case-by-case basis. We generally expect requests to be in writing, issued by an authorised authority, and sufficiently specific to identify the legal basis, the requesting agency, the accounts or records sought, and the applicable time period.
Where permitted, we may require clarification, narrow overly broad requests, reject requests that are invalid or disproportionate, and seek protective measures. Except where prohibited or where doing so would create risk of harm or compromise an investigation, we may notify affected users of requests for their information.

2.10 Government Request Policy
YOUUcheck aims to handle government, regulatory, and law enforcement requests responsibly, lawfully, and with regard to user rights, platform safety, and applicable legal obligations. We may preserve records where reasonably necessary for anticipated legal process or security investigations. We reserve the right to challenge or narrow requests that appear defective, overbroad, inconsistent with applicable law, or lacking proper authority. We may publish transparency information in aggregated form if and when we choose to do so.

2.11 Copyright Policy
YOUUcheck respects intellectual property rights and expects users to do the same. If you believe that content available through the Services infringes copyright or other intellectual property rights, you may send a complaint to info@youucheck.com with sufficient information to identify the work claimed to be infringed, the allegedly infringing material, your contact information, the basis of your claim, and a statement that the information provided is accurate and made in good faith. We may remove or restrict access to challenged material, request additional information, notify the affected user, and take appropriate action under applicable law.
If YOUUcheck offers services to users in the United States and seeks to rely on the online service provider safe-harbour framework under section 512 of the U.S. Copyright Act, a notice-and-takedown process and designated agent information may be required as part of compliance. The U.S. Copyright Office explains that participating online service providers generally need to cooperate with notice-and-takedown procedures and designate an agent for copyright notices.

2.12 International Terms Addendum and Country-Specific Schedules

2.12.1 General International Availability
YOUUcheck is operated from Hong Kong SAR and may be accessible from multiple jurisdictions. We do not represent that the Services, any feature, any paid service, any Tickens function, any company listing, any rating system, or any content is appropriate, lawful, available, or approved for use in every country or region. We may restrict, suspend, modify, block, geofence, or discontinue access to all or part of the Services in any jurisdiction at any time where we consider it necessary or appropriate for legal, regulatory, operational, payment, security, sanctions, technical, or business reasons.

2.12.2 Mandatory Local Law and User Responsibility
If you access or use the Services from outside Hong Kong SAR, you are responsible for complying with all laws and regulations that apply to you, your organisation, your project, your profession, your content, and your use of the Services. Where mandatory local law gives you rights or protections that cannot legally be waived or limited by contract, those rights and protections will apply only to the extent required by that mandatory law. Nothing in these Terms is intended to exclude, restrict, or modify any non-excludable consumer, privacy, employment, data protection, platform safety, or statutory right that applies to you.

2.12.3 Local Project, Professional, Contractor, and Marketplace Laws
Users are solely responsible for complying with all local laws, regulations, codes, permits, licences, registrations, qualifications, professional standards, insurance requirements, employment rules, tax obligations, safety requirements, consumer protection duties, construction and renovation rules, property management rules, and trade or contractor obligations that apply to their projects, services, businesses, listings, quotations, communications, uploaded materials, ratings, reviews, and transactions. YOUUcheck does not verify, supervise, control, inspect, certify, licence, guarantee, or assume responsibility for whether any user, freelancer, company, contractor, designer, consultant, supplier, owner, client, project participant, project, quotation, work, service, material, schedule, budget, upload, or transaction complies with local law or professional requirements.
Public profiles, company listings, freelancer listings, ratings, rankings, reviews, quotations, calendar entries, project records, reports, database information, and platform tools are provided to support user communication, record management, discovery, and project follow-up only. They do not constitute YOUUcheck’s endorsement, approval, guarantee, verification, certification, professional recommendation, project supervision, legal advice, construction advice, financial advice, or assumption of responsibility for any user or project. Where local laws impose obligations directly on owners, clients, designers, contractors, freelancers, companies, suppliers, professionals, employers, or other users, those obligations remain with the relevant users unless mandatory law expressly provides otherwise.
YOUUcheck may, but is not obliged to, request evidence of compliance, restrict features, suspend accounts, remove or de-rank listings, remove content, disable ratings or reviews, block transactions, limit project workspaces, or restrict access in any jurisdiction where we believe there may be legal, regulatory, safety, professional, consumer, payment, reputational, or platform-integrity risk. Any such action or inaction does not make YOUUcheck responsible for the underlying project, user relationship, contract, quotation, service, work, payment, dispute, or legal compliance matter.
2.12.4 International Data Transfers and Local Access Restrictions
By using the Services, you understand that information may be processed, stored, accessed, supported, backed up, or transferred in or from jurisdictions other than the one in which you are located. We will take reasonable steps appropriate to the circumstances to protect personal data in accordance with applicable law and our Privacy Policy. Some jurisdictions may restrict cross-border transfer, remote access, hosting, or publication of certain data, including personal data, project information, geolocation information, construction or property-related records, sensitive documents, minor-related data, or professional records. Users must not upload, transfer, publish, or invite access to information where doing so would violate applicable law or contractual duties owed to others.

2.12.5 Sanctions, Export Controls, and Prohibited Territories
You must not access, use, purchase, sell, transfer, or make available the Services, Tickens, reports, software, technical information, or platform content in breach of applicable sanctions, export control, trade control, anti-money laundering, anti-bribery, anti-corruption, or counter-terrorism financing laws. You represent that you are not located in, organised under the laws of, ordinarily resident in, or acting on behalf of any person or entity in a jurisdiction or on a list where use of the Services would be prohibited. We may screen, restrict, reject, suspend, or terminate accounts, payments, transactions, or access where we believe this is necessary for compliance or risk management.

2.12.6 International Ratings, Reviews, and Rankings
YOUUcheck’s ratings, review tools, validation process, scoring categories, database records, and ranking lists may be subject to consumer protection, advertising, unfair competition, defamation, professional regulation, platform transparency, and anti-manipulation rules in different jurisdictions. Users must not buy, sell, trade, coerce, threaten, fake, suppress, manipulate, or coordinate ratings or reviews. YOUUcheck may moderate, validate, remove, de-rank, adjust, or refuse to publish ratings and rankings where we consider it appropriate for fairness, authenticity, legal compliance, user trust, or platform integrity. Scores and rankings are informational tools only and are not guarantees of quality, licensing, legality, safety, financial condition, professional competence, or future performance.

2.12.7 Minors and Guardian Consent Across Jurisdictions
Where users below the age of majority are permitted to use the Services, such use must be with the consent and supervision of a parent or legal guardian. Age thresholds, parental consent rules, child privacy rules, age-assurance requirements, advertising restrictions, and public-sharing restrictions differ by jurisdiction. YOUUcheck may impose age gates, consent checks, feature restrictions, account limitations, content limitations, or additional verification requirements where we consider this necessary or appropriate. Parents and guardians are responsible for supervising minors’ use of the Services and for ensuring that minors do not upload sensitive project information, personal data, images, videos, or other content without appropriate rights and consent.
Schedule A – United States
If you are located in the United States, federal and state laws may impose additional requirements concerning consumer protection, privacy, children’s data, electronic contracting, automatic renewals, copyright, advertising, reviews, dispute resolution, and unfair or deceptive practices. California residents may have privacy rights under the California Consumer Privacy Act as amended, including rights to know, delete, correct, opt out of certain sale or sharing, limit certain sensitive information use, and avoid discrimination for exercising rights, where the law applies to the business. The California Attorney General describes the CCPA as giving consumers more control over personal information collected about them and requiring covered businesses to provide notices and respond to consumer requests.
If YOUUcheck is directed to children under 13 in the United States or has actual knowledge that it collects personal information from children under 13, the U.S. Children’s Online Privacy Protection Rule may require notice and verifiable parental consent before collecting, using, or disclosing such personal information. The U.S. Federal Trade Commission explains that the COPPA Rule sets out what covered operators must do to protect children’s privacy and safety online, including parental consent requirements.  YOUUcheck may restrict or modify access for users under relevant age thresholds where needed.
If YOUUcheck seeks to rely on U.S. online service provider copyright safe-harbour rules, additional operational steps may be required, including appropriate notice-and-takedown procedures and designated agent information. Any arbitration, class action waiver, jury waiver, or limitation of remedies applicable to U.S. users should be reviewed by U.S. counsel before adoption, because enforceability may vary by state, claim type, consumer status, and presentation of the terms.
Schedule B – European Union and United Kingdom
If YOUUcheck actively offers Services to users in the European Union, European Economic Area, or United Kingdom, additional data protection, consumer, platform, and online safety obligations may apply. Where the EU General Data Protection Regulation, UK GDPR, or related national laws apply, users may have rights such as access, correction, deletion, objection, restriction, portability, and rights relating to certain automated decisions. YOUUcheck may need to identify applicable controller or processor roles, lawful bases, international transfer safeguards, retention rules, security measures, and representative or contact arrangements.
The EU Digital Services Act establishes due diligence and transparency obligations for certain intermediary services offered to users in the EU, including points of contact for authorities and recipients, notice-and-action mechanisms for hosting services, and additional obligations for online platforms depending on service type and size.  If YOUUcheck falls within scope, it may need to maintain required contact points, content reporting processes, moderation explanations, complaint handling, transparency reporting, and trader or business-user information processes.
In the United Kingdom, the Online Safety Act 2023 may apply to certain user-to-user or search services, including duties relating to illegal content risk assessments, safety measures, record-keeping, content reporting, complaints procedures, and child safety where the service is likely to be accessed by children.  YOUUcheck may restrict features, sharing, messaging, public posts, or minor access in the UK where needed for compliance.
Schedule C – Australia
If you are an Australian consumer or small business, the Australian Consumer Law may provide guarantees, remedies, and protections that cannot be excluded, including protections concerning services provided with due care and skill, misleading or deceptive conduct, unfair practices, unfair contract terms, and refund rights where statutory guarantees are not met. The Australian Competition and Consumer Commission explains that consumer rights under law cannot be taken away by contract terms and that laws protect consumers and small businesses from unfair terms in standard form contracts.
For Australian users, any refund, limitation of liability, unilateral variation, ranking, review, suspension, or termination clause in these Terms applies only to the extent permitted by the Australian Consumer Law and other applicable laws. YOUUcheck’s review and ranking features must not be used to publish false, misleading, manipulated, or unfairly obtained reviews or ratings.
Schedule D – Singapore
If Singapore law applies to YOUUcheck’s handling of personal data, the Personal Data Protection Act 2012 may require compliance with obligations including accountability, notification, consent, purpose limitation, accuracy, protection, retention limitation, transfer limitation, access, correction, and data breach notification. Singapore’s Personal Data Protection Commission describes these data protection obligations and the expectation that organisations designate a data protection officer and make relevant business contact information available.
Where Singapore PDPA requirements apply, requests relating to access, correction, withdrawal of consent, complaints, or data protection matters may be sent to info@youucheck.com. YOUUcheck may require identity verification, limit requests where permitted by law, and respond within timeframes required by applicable law.
Schedule E – Mainland China
If YOUUcheck processes personal information of individuals located in Mainland China for the purpose of providing products or services to them or analysing or evaluating their behaviour, Mainland China’s Personal Information Protection Law and related cybersecurity, data security, content, data export, and platform rules may apply. Public summaries of the PIPL note that it has extraterritorial reach and may require specific processing bases, notices, separate consent for certain activities, individual rights, security measures, and cross-border transfer compliance.
YOUUcheck may restrict Mainland China access, accounts, features, content publication, public listings, messaging, data transfers, payments, or project data uploads where we consider it necessary for compliance, licensing, security, content control, data export, or operational reasons. Users must not upload or transfer information from Mainland China where doing so would breach applicable data localisation, cybersecurity, professional, confidentiality, state secrets, mapping, construction, property, employment, or personal information rules.
Schedule F – Macau SAR and Taiwan
If you access the Services from Macau SAR or Taiwan, local privacy, consumer, electronic transaction, advertising, defamation, professional, and platform-related laws may apply. YOUUcheck may provide additional notices or localised terms where required. Users are responsible for ensuring that company listings, professional claims, reviews, project information, and uploaded materials are lawful and accurate under applicable local law.
Schedule G – Japan
If YOUUcheck handles personal information of individuals in Japan in connection with providing goods or services, Japan’s Act on the Protection of Personal Information may apply, including rules concerning purposes of use, third-party provision, cross-border transfers, data subject rights, security controls, and breach notification. Japan’s Personal Information Protection Commission publishes materials relating to the Act on the Protection of Personal Information and related rules and guidelines.
Schedule H – Canada
If YOUUcheck handles personal information in the course of commercial activities involving Canada, the Personal Information Protection and Electronic Documents Act or substantially similar provincial privacy laws may apply. The Office of the Privacy Commissioner of Canada explains that PIPEDA sets ground rules for how private-sector organisations collect, use, and disclose personal information in commercial activities and is based on principles including accountability, identifying purposes, consent, limiting collection, safeguards, openness, individual access, and challenging compliance.
Schedule I – Other Jurisdictions and Future Local Terms
For any country or region not specifically listed above, local laws may still apply to privacy, consumer protection, professional regulation, construction and property services, electronic contracting, payments, advertising, intellectual property, defamation, online safety, user-generated content, minors, dispute resolution, taxation, sanctions, and data transfers. YOUUcheck may issue additional country-specific terms, product notices, consent flows, privacy disclosures, payment terms, or feature restrictions as the Services expand. If any local addendum conflicts with these Terms, the local addendum will control only for the relevant jurisdiction and only to the extent of the conflict.
Privacy-related international notices: Additional privacy, personal data, data transfer, child privacy, and government-access requirements for specific countries or regions are also addressed in the YOUUcheck Privacy and Data Protection Policy. Where a privacy-specific local notice conflicts with these Terms, the privacy-specific notice will apply only to the extent required by applicable law.

视您使用服务的方式而定,我们可能收集账户资料、联系方式、业务资料、项目信息、进度和预算数据、上传文件、照片、视频、评价、消息、使用日志、设备和浏览器信息、与IP相关的信息、交易和付款元数据、客户支持通信,以及您选择提供的其他信息。业务资料、自由职业者资料、公司列表信息、公开评价、公开项目展示,以及您选择或授权发布的其他信息,可能会根据相关功能和设置向其他用户或公众可见。个人项目资料,包括项目进度、预算、私人通信、上传的项目照片、文件、记录、报告及其他项目特定材料,原则上仅供悠评以及获授权或受邀访问相关项目工作区的用户、项目参与者、服务提供商、账户管理员或其他人员访问;但在法律要求或允许、服务运营、安全、争议处理、技术支持、付款处理、执行我们的条款、保护权利或安全,或用户选择、授权或配置分享的情况下,可能会披露。我们将采用合理措施保护该等项目资料,但不保证绝对保密、安全,亦不保证能够防止所有未经授权访问、错误、用户配置不当、第三方故障或违法行为。

2.2 使用目的

2.3 法律与合规说明
根据香港《电子交易条例》(第553章),在若干法定例外的限制下,香港在许多商业情境中承认电子记录和电子签名,从而支持许多交易中的线上订约及电子通信。个人数据应以合法和公平方式收集;除非取得同意或另有合法依据,否则应仅用于与原收集目的直接相关的用途;并应保持准确、不得保留超过必要期限,且应以适当保障措施予以保护。

2.4 个人数据共享
在为本政策所述目的而合理必要的范围内,我们可与代表我们行事的服务提供商和处理者分享个人数据,包括托管服务提供商、分析服务提供商、通讯供应商、客户支持工具、安全服务提供商,以及AsiaPay等付款处理机构。当服务功能本身需要向其他用户分享数据时,例如用户有意公开公司资料、项目展示、评价或协作项目信息,我们亦可进行分享。我们亦可在法律、法院命令、合法请求要求时,或为保护权利、安全、财产或服务完整性而披露数据。

2.8 可接受使用政策
您不得使用悠评从事违法、有害、欺骗、滥用、侵权或不安全的行为。禁止行为包括上传您无权使用的内容;发布诽谤性或欺诈性材料;虚假陈述公司资质、许可证、预算、项目进度或评价;侵犯隐私;未经授权收集其他用户数据;传播垃圾信息或恶意软件;干扰网络或平台安全;尝试未经授权访问;以被禁止方式使用机器人或抓取工具;规避付款或访问控制;以及使用服务违反法律或第三方权利。
我们可调查违规行为,并在适用法律规限下采取我们认为适当的任何措施,包括移除内容、发出警告、限制功能、暂停账户、终止账户、向有关机关报告及采取法律行动。

2.9 执法数据请求指南
仅在我们认为披露属法律要求、法律允许,或为回应有效且合法的请求、保护生命或安全、调查欺诈或滥用,或维护服务安全与完整性所必要时,悠评方可披露用户信息。我们会逐案审查请求。我们通常要求请求以书面形式提出,由获授权机关发出,并足够具体地说明法律依据、请求机关、所涉账户或记录及适用时间范围。
在允许的情况下,我们可要求澄清、缩小过于宽泛的请求、拒绝无效或不相称的请求,并寻求保护措施。除非被禁止,或通知会造成损害风险或影响调查,否则我们可通知受影响用户其信息被请求的情况。

2.10 政府请求政策
悠评旨在以负责任、合法并兼顾用户权利、平台安全及适用法律义务的方式处理政府、监管及执法请求。我们可在预期法律程序或安全调查合理需要时保存记录。我们保留质疑或缩小看来存在缺陷、过于宽泛、不符合适用法律或缺乏适当权限的请求的权利。我们可在选择这样做时以汇总形式发布透明度信息。

2.11 版权政策
悠评尊重知识产权,并要求用户亦同样尊重知识产权。如果您认为服务中可用的内容侵犯版权或其他知识产权,您可向info@youucheck.com发送投诉,并提供足够资料以识别据称被侵权的作品、涉嫌侵权的材料、您的联系方式、您的投诉依据,以及一项声明,确认所提供资料准确且基于善意作出。我们可移除或限制对被投诉材料的访问,要求提供补充资料,通知受影响用户,并根据适用法律采取适当行动。
如果悠评向美国用户提供服务,并希望依据美国《版权法》第512条项下的在线服务提供商安全港框架,则作为合规的一部分,可能需要建立通知与移除程序,并提供指定代理人信息。参与该等安全港机制的在线服务提供商通常需要配合通知与移除程序,并指定版权通知代理人。

2.12 国际条款附录及国家/地区特定附表

2.12.1 一般国际可用性
悠评由香港特别行政区运营,并可能可从多个司法管辖区访问。我们不声明服务、任何功能、任何付费服务、任何悠币功能、任何公司列表、任何评分系统或任何内容在每个国家或地区均适当、合法、可用或获批准使用。凡我们认为因法律、监管、运营、付款、安全、制裁、技术或商业原因有必要或适当时,我们可在任何司法管辖区随时限制、暂停、修改、阻止、按地区限制或终止对全部或部分服务的访问。

2.12.2 强制性当地法律与用户责任
如您从香港特别行政区以外访问或使用服务,您有责任遵守适用于您、您的组织、您的项目、您的专业、您的内容及您使用服务的所有法律法规。凡强制性当地法律赋予您不得通过合同合法放弃或限制的权利或保护,该等权利和保护仅在该强制性法律要求的范围内适用。本条款中的任何内容均无意排除、限制或修改适用于您的任何不可排除的消费者、隐私、雇佣、数据保护、平台安全或法定权利。

2.12.3 当地项目、专业、承包商及市场法律
用户须自行负责遵守适用于其项目、服务、业务、列表、报价、通信、上传材料、评分、评价及交易的所有当地法律、法规、守则、许可、牌照、登记、资质、专业标准、保险要求、雇佣规则、税务义务、安全要求、消费者保护义务、施工及装修规则、物业管理规则,以及行业或承包商义务。悠评不核实、监督、控制、检查、认证、发牌、保证或承担任何用户、自由职业者、公司、承包商、设计师、顾问、供应商、业主、客户、项目参与者、项目、报价、工程、服务、材料、进度、预算、上传内容或交易是否符合当地法律或专业要求的责任。
公开资料、公司列表、自由职业者列表、评分、排名、评价、报价、日历条目、项目记录、报告、数据库信息及平台工具仅用于支持用户沟通、记录管理、发现及项目跟进。其不构成悠评对任何用户或项目的背书、批准、保证、核实、认证、专业推荐、项目监督、法律意见、施工意见、财务意见或责任承担。凡当地法律直接对业主、客户、设计师、承包商、自由职业者、公司、供应商、专业人士、雇主或其他用户施加义务,该等义务仍由相关用户承担,除非强制性法律另有明确规定。
凡我们认为在任何司法管辖区可能存在法律、监管、安全、专业、消费者、付款、声誉或平台完整性风险时,悠评可要求提供合规证明、限制功能、暂停账户、移除或降低列表排名、移除内容、禁用评分或评价、阻止交易、限制项目工作区,或限制访问,但我们并无义务这样做。任何该等作为或不作为均不使悠评对相关项目、用户关系、合同、报价、服务、工程、付款、争议或法律合规事项承担责任。

2.12.4 国际数据转移及当地访问限制
使用服务即表示您理解,信息可能会在您所在司法管辖区以外的地区被处理、存储、访问、支持、备份或转移。我们将根据具体情况采取合理步骤,按照适用法律及我们的隐私政策保护个人数据。某些司法管辖区可能限制特定数据的跨境转移、远程访问、托管或发布,包括个人数据、项目信息、地理位置信息、施工或物业相关记录、敏感文件、未成年人相关数据或专业记录。用户不得上传、转移、发布或邀请访问任何会违反适用法律或其对他人承担的合同义务的信息。

2.12.5 制裁、出口管制及禁止地区
您不得在违反适用制裁、出口管制、贸易管制、反洗钱、反贿赂、反腐败或反恐怖融资法律的情况下访问、使用、购买、出售、转移或提供服务、悠币、报告、软件、技术信息或平台内容。您声明您并非位于、根据其法律设立、通常居住于或代表任何在有关司法管辖区或名单上、使使用服务被禁止的人士或实体行事。凡我们认为出于合规或风险管理需要时,我们可筛查、限制、拒绝、暂停或终止账户、付款、交易或访问。

2.12.6 国际评分、评价及排名
悠评的评分、评价工具、验证流程、评分类别、数据库记录及排名列表,在不同司法管辖区可能受消费者保护、广告、不正当竞争、诽谤、专业监管、平台透明度及反操纵规则约束。用户不得购买、出售、交换、胁迫、威胁、伪造、压制、操纵或协调评分或评价。凡我们认为出于公平性、真实性、法律合规、用户信任或平台完整性需要时,悠评可管理、验证、移除、降低排名、调整或拒绝发布评分及排名。评分和排名仅为信息工具,并非对质量、牌照、合法性、安全、财务状况、专业能力或未来表现的保证。

2.12.7 各司法管辖区的未成年人及监护人同意
凡允许未达到成年年龄的用户使用服务,该等使用必须取得父母或法定监护人的同意并受其监督。不同司法管辖区对于年龄门槛、父母同意、儿童隐私、年龄确认、广告限制及公开分享限制的规定各不相同。悠评可在我们认为必要或适当时设置年龄限制、同意检查、功能限制、账户限制、内容限制或额外验证要求。父母及监护人负责监督未成年人使用服务,并确保未成年人不会在未取得适当权利和同意的情况下上传敏感项目信息、个人数据、图像、视频或其他内容。

附表A-美国
如您位于美国,联邦及州法律可能就消费者保护、隐私、儿童数据、电子订约、自动续期、版权、广告、评价、争议解决以及不公平或欺骗性行为施加额外要求。加利福尼亚居民在适用法律适用于相关业务的情况下,可能根据经修订的《加利福尼亚消费者隐私法》享有隐私权,包括知情权、删除权、更正权、选择退出某些出售或共享的权利、限制某些敏感信息使用的权利,以及因行使权利而不受歧视的权利。
如悠评面向美国13岁以下儿童,或实际知悉其收集13岁以下儿童的个人信息,美国《儿童在线隐私保护规则》可能要求在收集、使用或披露该等个人信息前提供通知并取得可验证的父母同意。悠评可在需要时限制或修改低于相关年龄门槛用户的访问。
如悠评希望依赖美国在线服务提供商版权安全港规则,可能需要采取额外运营步骤,包括适当的通知与移除程序及指定代理人信息。任何适用于美国用户的仲裁、集体诉讼豁免、陪审团审判豁免或救济限制条款,在采用前均应由美国律师审查,因为其可执行性可能因州份、索赔类型、消费者身份及条款呈现方式而异。

附表B-欧盟和英国
如悠评主动向欧盟、欧洲经济区或英国用户提供服务,可能适用额外的数据保护、消费者、平台及在线安全义务。在欧盟《通用数据保护条例》、英国GDPR或相关国家法律适用的情况下,用户可能享有访问、更正、删除、反对、限制、数据可携带,以及与某些自动化决定有关的权利。悠评可能需要识别适用的控制者或处理者角色、合法依据、国际转移保障措施、保留规则、安全措施,以及代表或联络安排。
欧盟《数字服务法》为向欧盟用户提供的某些中介服务设立尽职调查及透明度义务,包括面向主管机关及服务接收方的联系点、托管服务的通知与行动机制,以及视服务类型和规模而定的在线平台额外义务。如悠评属于适用范围,可能需要维持所需联系点、内容举报流程、内容管理说明、投诉处理、透明度报告,以及交易者或商业用户信息流程。
在英国,《2023年在线安全法》可能适用于某些用户对用户服务或搜索服务,包括与非法内容风险评估、安全措施、记录保存、内容举报、投诉程序,以及在服务可能被儿童访问时的儿童安全有关的义务。悠评可在为合规所需时限制英国境内的功能、分享、消息、公开帖子或未成年人访问。

附表C-澳大利亚
如您是澳大利亚消费者或小型企业,澳大利亚消费者法可能赋予不可排除的保证、救济和保护,包括关于以适当谨慎和技能提供服务、误导或欺骗性行为、不公平做法、不公平合同条款,以及在未达到法定保证时的退款权利等保护。任何退款、责任限制、单方变更、排名、评价、暂停或终止条款,仅在澳大利亚消费者法及其他适用法律允许的范围内适用于澳大利亚用户。
悠评的评价和排名功能不得用于发布虚假、误导、被操纵或以不公平方式取得的评价或评分。凡法律要求给予消费者保证或法定救济,本条款不得解释为排除、限制或修改该等不可排除权利。

附表D-新加坡
如新加坡法律适用于悠评处理个人数据的活动,《2012年个人数据保护法》可能要求遵守包括问责、通知、同意、目的限制、准确性、保护、保留限制、转移限制、访问、更正及数据泄露通知在内的义务。组织通常应指定数据保护负责人,并提供相关业务联系方式。
在新加坡PDPA要求适用的情况下,与访问、更正、撤回同意、投诉或数据保护事项有关的请求可发送至info@youucheck.com。悠评可要求进行身份验证,在法律允许范围内限制请求,并在适用法律要求的时限内作出回应。

附表E-中国内地
如悠评为向位于中国内地的个人提供产品或服务,或分析、评估其行为而处理该等个人的个人信息,中国内地的《个人信息保护法》以及相关网络安全、数据安全、内容、数据出境及平台规则可能适用。该等规则可能要求具备特定处理依据、提供通知、就若干活动取得单独同意、保障个人权利、采取安全措施,并遵守跨境转移合规要求。
凡我们认为出于合规、许可、安全、内容管理、数据出境或运营原因有必要时,悠评可限制中国内地访问、账户、功能、内容发布、公开列表、消息、数据转移、付款或项目数据上传。用户不得从中国内地上传或转移会违反适用数据本地化、网络安全、专业、保密、国家秘密、测绘、施工、物业、雇佣或个人信息规则的信息。

附表F-澳门特别行政区和台湾
如您从澳门特别行政区或台湾访问服务,当地隐私、消费者、电子交易、广告、诽谤、专业及平台相关法律可能适用。悠评可在法律要求时提供额外通知或本地化条款。用户负责确保公司列表、专业声明、评价、项目信息及上传材料在适用当地法律下合法且准确。

附表G-日本
如悠评在提供商品或服务相关情况下处理日本个人的个人信息,日本《个人信息保护法》可能适用,包括关于使用目的、向第三方提供、跨境转移、数据主体权利、安全控制及泄露通知的规则。悠评可在必要时提供额外通知、同意流程或本地化隐私说明。

附表H-加拿大
